Terms & Conditions

1. Your Contract

Andalucian Villa Rentals is the trading name of Pertle Limited which is registered in the UK at Wincham House. Greenfield Farm Trading Estate, Congleton, Cheshire. CW12 4TR, the registration number of the company is 08123070. Andalucian Villa Rentals are the letting agents for the owners of the properties offered on this web site. Any contract is between the owners of the property and the applicant.

2. Making a Reservation

For us to accept your booking, the person making the booking must read all of the following conditions. The person who submits the booking form does so on behalf of all the members of the party and binds them to these terms and conditions.

3. Method of payment

For Sterling bookings, payment can either be made by bank transfer or through our website via credit or debit card. Euro bookings payment can be made by bank transfer to our euro account and through our website. We will hold your selected property for three days whilst you arrange payment, unless your booking is due to commence in the next 42 days in which case you will have two days to arrange full payment, otherwise your booking will be automatically cancelled. All card transactions are billed in GBP and converted to your local currency by the card issuer at their prevailing rate. Please note that there is no transaction surcharge for paying with a debit or a credit card.

4. Deposit Payment

At the time of your reservation, you will be asked for an initial deposit of 25% of the total cost of the holiday. There will be nothing else to pay until six weeks prior to your arrival.

5. Balance Payment

The balance of the holiday cost must be paid at least six weeks prior to arrival. Please ensure that payment is made within that time otherwise we reserve the right to treat your booking as cancelled. Should this be the case you could be liable to pay us the cancellation charges shown below. If you arrange your holiday within six weeks of travelling, then full payment becomes due with your booking.

6. Cancelling A Booking

Should you wish to cancel your booking you must do so by sending written confirmation. In the event of a cancellation, and to compensate for the expense of processing your booking and for any loss that may result from being unable to re-rent the property, we charge the following cancellation fees:

7. Insurance

We strongly recommend that you and all members of your party be suitably insured. Holiday and travel insurance, including cancellation cover, is essential for your protection. If you choose to travel without sufficient holiday insurance cover, we will not be liable for any losses however arising, in respect of which insurance cover would otherwise have been available.

8. Damage deposit

We add a refundable damage deposit of £150/€150 to your balance payment. This is usually returned to a bank of your choice within five working days of your holidays end, subject to a final clean and check. This is to cover accidental damage that may occur in the property during your holiday. Please note that wilful and negligent behaviour is not covered by this charge, should this occur, you may be asked to cover the cost of the damage.

9. Passport Information & Personal Data

As required by Spanish law, we are obliged to obtain and pass to the local authorities’ passport and other personal details of all guests aged sixteen years and over: the same process as hotels when checking in guests. As such you need to update this information on the booking form before arrival. Failure to provide this information could result in access to your property being denied, and no compensation or refund will be due in these circumstances. It also speeds up the check in process on arrival. Once we have used the information solely for this booking, and for legal requirements, your personal information is deleted from our systems.

10. Party Size

Over-occupancy of any property is not allowed. Only the guests listed on the booking form may occupy the property during your stay. This includes outside areas of properties, pool areas, and communal areas of properties with shared pools and gardens. We,  and the property agents, reserve the right to refuse admittance and/or require guests to leave if this stipulation is not adhered to. Please note no refund would be due in these circumstances. Your guest list can be amended at any time prior to arrival by resubmitting your booking form.

11. Subletting & Commercial Use

Guests are not permitted to sub-let or resell their booked dates. Your chosen property is to be used exclusively by the people on your guest list. It is also not permitted to use the property for commercial or illegal purposes.

12. Problems With Your Property

If you have a problem during your holiday, immediately inform the local agent who will then endeavour to put things right. We cannot accept responsibility if you fail to do this, as we have not had the opportunity to investigate and rectify the problem. Although we will make every effort to deal with problems promptly, a reasonable amount of time should be allowed for repairs to be completed by outside contractors. In the unlikely event that a problem is not satisfactorily resolved during your stay we require written notification within 14 days of the completion of your holiday. Please note that we accept no liability for failure of public supplies or utilities such as water, electricity & internet over which we have no control over mechanical equipment, nor of sewage systems or plumbing in the villas, but shall use our skills and knowledge to arrange prompt repairs where possible. Most of our villas have their own water tanks.

13. Check in & Check out times

Your accommodation is available after 16.00 on day of arrival and must be vacated by 10.00 on day of departure. The housekeepers, gardeners and pool cleaners need this time to prepare the accommodation properly for incoming guests. Although you are not required to vacate your property before 10.00 please be aware that some staff could possibly arrive before this time.

14. Change and Non-Availability of accommodation

It may be unavoidable, sometimes we have to change your chosen villa because of circumstances beyond ours, or the owners control; we will inform you of this as soon as we know and offer you either alternative accommodation of similar or superior standard, a refund if nothing is suitable, or discuss other options. No further claim against the owner, or Andalucian Villa Rentals for any loss suffered, will be considered.

15. Liability

Andalucian Villa Rentals do not accept liability for any act or neglect on the part of the owners or any other person not within their employ or their control, nor for any accident, damage, loss, injury or expense, whether to person or property, which the tenants may suffer arising out of, or in any way connected with the letting. The owner and the letting agent also accept no liability for loss of or damage to the tenants’ possessions on the owners’ property.

16. Functions

You must inform us at the time of booking if you plan to hold a function at your rental property, and request permission. Failure to follow our guidelines can result in Andalucian Villa Rentals, the property owner, or their agent cancelling the event. Also note: any complaints from neighbours, Guardia Civil or any legal action resulting from your function is the responsibility of yourselves, and not Andalucian Villa Rentals or the owner.

17. Fire Hazards

Andalucian Villa Rentals do not accept any responsibility for any negligent fire damage caused by the tenants. Smoking is strictly prohibited inside all properties. This will also lead to forfeiting the damage deposit.

18. Property Standards

Our villas are carefully selected and inspected by us; all the properties we advertise we strive to maintain high standards. However, from time-to-time items break or require maintenance, therefore please be aware that you may encounter maintenance staff and gardeners during your stay. Also remember, these are people’s homes please leave your villa in a reasonably clean and tidy condition, all rubbish must be removed at the end of your stay. We reserve the right to charge for extra cleaning and rubbish removal if necessary, and to take this from your damage deposit.

19. Accuracy

We try to ensure that all the information including photographs and property descriptions on our website are accurate. Sometimes changes and errors occur, we reserve the right to correct these details when that happens. Also, items break and may sometimes change and therefore furniture, appliances etc. may vary from our website text and photographs. We accept no liability should a description or a photograph be inaccurate. If a particular facility offered in a property is essential to the booking of your holiday, such as pool heating, please ensure that we are made aware of this at the booking stage.

20. Availability of Amenities and Facilities

Occasionally, some facilities and amenities may not be available or could be restricted. Whilst we will strive to keep this to a minimum Andalucian Villa Rentals will not be held responsible and does not accept any liability should any facilities and amenities not be available at any point during your stay. This includes, but is not limited to, any local communal facilities you might see advertised, such as indoor and outdoor swimming pools, gyms, tennis courts, spa facilities, restaurants etc.

21. Health And Safety

Immediately upon arrival at your holiday home please read the welcome book and familiarise yourself with the layout of the property and identify any potential hazards, for example: swimming pools, pool depths, steps, balconies, sliding glass doors, etc. etc. You must ensure hazards are pointed out to other members of your party, especially children, they must be always under supervision around the swimming pool. Please inform the local agent if you have any questions or concerns about your property. The use of any swimming pools and Jacuzzis are at your own risk. Please note that all our villas have tiled floors, they can become slippery when wet, or of course when feet are wet. You are responsible for the care and safety of yourself and other members of your party. Any accidents must be reported to the local representative immediately.

22. Noise

Most of our properties are in rural locations and as such there maybe sheep and goat noises in the vicinity. Please remember that sound travels and noise should be kept to reasonable levels especially after 11 pm. Rarely, building work might be in close proximity to our properties it may occur without any prior warning, this is beyond our control.

23. Local Wildlife

Most of our properties are in rural locations or surrounded by gardens, it is possible that you might encounter some of the local wildlife i.e. wasps, ants, mosquitoes, cockroaches, native rodents – fruit rats etc. etc Andalucian Villa Rentals will not be held responsible for their presence or control, but we will make every effort to eradicate pests.

24. Safes

In the properties that provide a security box for guest use Andalucian Villa Rentals cannot accept responsibility for any loss under any circumstances.

25. TV Reception

TV Reception is not guarantee and can be affected by a great many things. Andalucian Villa Rentals will not be held responsible for the availability or reception quality of any TV channels.

26. Air Conditioning

We accept no responsibility for the breakdown of air conditioning units under any circumstances although we will always strive to rectify the matter as soon as possible. Full air conditioning means that it is available in all the bedrooms and the living areas unless stipulated otherwise. It is an expensive commodity, therefore it should be switched off in all empty rooms, and when away from the villa. This will also be a condition of the damage deposit.

27. Swimming Pools Hot Tubs And Jacuzzis

Swimming pools etc. have their chemical levels regularly checked. If you have any concerns about them, please report it to the local representative immediately. Despite having the correct chemical levels, swimwear and some hair colours might discolour. This does not mean the chemical balance is incorrect and we accept no responsibility for such damage. We would recommend rinsing all swimwear in fresh water after each swim and using a shampoo during your stay and for a short time after your stay especially if you have dyed or blonde hair.

28. Pool Heating And Pool Lights

We make every effort to ensure that pool heaters are in working order, unfortunately sometimes they break; therefore if a pool or Jacuzzi cannot be satisfactorily heated our liability will be limited to the amount paid for pool / Jacuzzi heating.

Whilst most of our pools have lights we do not advertise them as having so, as we cannot ensure that the light will be working … they are very sensitive: water and electricity do not mix, and the bulbs can easily blow. To replace the lighting unit usually means that the pool level has to be lowered, due to water restrictions we cannot do.

29. Security

We are in a very low crime area but make sure that you fully secure the villa when out, at night, and when relaxing outside and around the pool. We do not accept liability for any theft/ loss of items. You must ensure you have suitable travel insurance in place to cover such eventualities.

30. Pets

Pets are welcome in only some of our properties. Should you wish to bring a pet, you will need to make sure Andalucian Villa Rentals are fully aware before your arrival.

31. Property suitability

To ensure a property is suitable for your needs – if there is someone in your party who has any special requirements, please let us know in writing prior to booking. We will be happy to advise you as to a property’s suitability for your requirements. Andalucian Villa Rentals cannot be held responsible for the suitability of any property if we are not advised of the requirements prior to booking.

32. Included in the Cost

If you are staying for up to 10 nights the housekeeping service will be on your day of arrival and day of departure. All villas have washing machines or, should you wish, additional cleaning & laundry can usually be arranged at an additional cost. If you have booked accommodation for more than11 nights, you will also have a mid-stay sheet and towel change, and a bathroom clean.

Assistance of our local representative if required during office hours 08.00- 20.00 unless in an emergency

33. Visas/ Travel Requirements

It is the guests responsibility to check they fulfil any and all travel requirements. Andalucian Villa Rentals, nor the owner, will accept any responsibility should you be unable to travel due to having not complied with any passport, visas, immigration or travel requirements.

34. Force Majeure

We will not be liable to refund beyond what is set out in clause 6 or compensate guests in relation for a “Force Majeure” situation. A Force Majeure includes any event, act, omission or action that is outside our reasonable control. For example: riot, civil unrest, industrial disputes, natural or nuclear disasters, adverse weather, fire, risk to human health such as the outbreak of a serious disease, an epidemic or pandemic, changes to law, natural disasters, acts of god, explosions, droughts, fires, riots, terrorist attacks, or threats thereof, war, including armed conflict, or threats thereof, and all similar events that make it difficult or impossible to travel safely to, or remain at your chosen property. Be aware that there will be some water restrictions in the whole of our area throughout the season of 2024.

35. Governing Law and Jurisdiction

The validity of this Agreement shall be governed by English Law. All guests submit to the exclusive jurisdiction of the English courts.

36. Blue Pencil Test

If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

The entire contents of this website, including text, photographs, videos, graphics, software, layout is owned by Pertle Limited. The entire contents of this website are protected by copyright law. You are not permitted, without our prior written consent, to copy, transmit, reproduce, publish, display, distribute, store, modify or adapt this website, its contents or underlying software, except for personal non-commercial use.
